Item Warranty.

In the event of any lack of conformity at the time of delivery of the goods, the entrepreneur will be liable to the consumer for any defects that become apparent within a period of three years from delivery, which will be deemed to have occurred on the date shown on the invoice or purchase receipt, or on the delivery note if this is later;

- Unless proven otherwise, any non-conformities that become apparent within two years of delivery of the goods shall be presumed to have already existed at the time of delivery.
- Through a simple declaration, the consumer may demand that the business remedy the lack of conformity, reduce the price, or terminate the contract.

To bring the goods into compliance, the consumer may choose repair or replacement, unless either option is impossible or involves disproportionate costs for the business. These measures must meet the following requirements:

- They will be free of charge for the consumer, including the costs necessary to bring the goods into conformity, especially shipping, transportation, labor or materials costs;
- They will be carried out within a reasonable time from the moment the employer has been informed of the lack of conformity and without major inconvenience to the employer.

The consumer will make the goods available to the entrepreneur, who will recover them at his own expense in the manner that causes the least inconvenience to the consumer depending on the type of goods.

The Contractor shall not be liable for any payment for normal use of the replaced goods during the period prior to their replacement. The Contractor, for its part, shall recover the goods at its own expense, remove the non-conforming goods, and, in the case of goods that have been installed, remove them and proceed to install the repaired or replaced goods, assuming any resulting costs.

The consumer will be provided with documentary evidence of the delivery of the goods by the consumer, stating the delivery date and the lack of conformity, as well as documentary evidence of the delivery of the goods already in conformity to the consumer, which must also state the date of that delivery and a description of the corrective measure taken.

The consumer may also demand a price reduction or termination of the contract. The price reduction will be proportional to the difference between the value the goods would have had at the time of delivery had they been in conformity, and the value the goods delivered have at the time of delivery. Termination will not be applicable when the lack of conformity is minor.

The consumer may opt for them provided the following requirements are met:

- When the measure to bring the goods into conformity is impossible or disproportionate;
- The entrepreneur has not carried out the repair or replacement or has not carried it out correctly;
- Any lack of conformity appears in the repaired or replaced goods;
- The lack of conformity is of such seriousness that it justifies one of the two options;
- The entrepreneur has declared, or it appears from the circumstances, that he will not bring the goods into conformity within a reasonable time or without major inconvenience to the consumer.

The entrepreneur will reimburse the consumer as a result of choosing these measures the price paid for the goods after receiving them back or, where appropriate, after proof provided by the consumer that they have been returned.

The consumer or user shall return the goods to the entrepreneur, at the latter's expense.

- The consumer may suspend the outstanding payment of the price until the entrepreneur fulfills his obligations;
- You may also request the correction of the lack of conformity, a reduction in price, or the termination of the contract if, as a result of the violation of third-party rights, the use of the good is prevented or limited;
- The consumer will not be liable for any payment for normal use of the replaced goods during the period prior to their replacement;
- Whether you request a remedy for the lack of conformity, a price reduction, or termination of the contract, you may claim compensation for damages if applicable.
